Terms of Service

These Terms of Service ("Terms") are a legal agreement between you ("you" or "User") and Better Stream ("Better Stream", "we", "us", or "our") governing your access to and use of the Better Stream browser extension, together with any related websites, documentation, and updates (collectively, the "Service").

By installing, accessing, or using the Service, you agree to be bound by these Terms and by our Privacy Policy, which is incorporated by reference. If you do not agree, do not install or use the Service.

You must be at least the age of majority in your jurisdiction (and in any event at least 18 years old, or 13 with the consent of a parent or legal guardian where permitted) to use the Service. By using the Service you represent and warrant that you meet these requirements and that you have the legal capacity to enter into these Terms.

Better Stream is a media player and organizational shell — nothing more. It provides a user interface, a video player, a library/organizer, and a plugin framework. It lets you add third-party plugins, add-ons, and playlists, and then browse, search, organize, and play media that those third-party sources provide.

Better Stream contains no media content, catalogs, streams, channels, or sources of its own. It does not host, store, upload, index, aggregate, or supply any media. All content, links, catalogs, streams, subtitles, and live channels come exclusively from third-party plugins and sources that you choose to install and use.

The Service is provided free of charge. We do not require an account, and your settings and data are stored locally on your device as described in the Privacy Policy.

The Service is designed to work with third-party plugins and playlists that you select. You acknowledge and agree that:

• We neither provide nor control them. Plugins, add-ons, playlists, repositories, metadata providers, and the content they surface are created, operated, and controlled by third parties, not by Better Stream.
• We do not endorse or verify them. We do not review, approve, endorse, or guarantee any third-party plugin or any content it provides, and we make no representation about its legality, safety, accuracy, or availability.
• Their terms govern. Your use of any third-party plugin or service is subject to that third party's own terms and privacy policy, for which you are responsible.
• You are solely responsible. You alone are responsible for choosing which plugins to install, for the sources you access, and for ensuring your use is lawful in your jurisdiction.

You are solely responsible for how you use the Service and for the content you access through it. You agree to use the Service only for lawful purposes and in compliance with all applicable laws, regulations, and the rights of third parties, including intellectual-property and copyright laws.

You agree that you will not, and will not use the Service to:

• Access, stream, download, distribute, or reproduce any content in violation of any copyright, trademark, or other intellectual-property right, or in violation of any applicable law
• Circumvent, disable, or interfere with security-related or access-control features of any third-party service
• Use the Service to infringe, misappropriate, or violate the rights of any person or entity
• Reverse engineer, decompile, or attempt to extract source code except to the extent this restriction is prohibited by applicable law
• Introduce malware, or use the Service to disrupt, damage, or gain unauthorized access to any system, network, or data
• Resell, sublicense, or commercially exploit the Service without our prior written permission
• Misrepresent your affiliation with Better Stream or use our name or marks without permission

Better Stream does not condone or authorize any use of the Service to access content without the right to do so. Responsibility for lawful use rests entirely with the User.

The Service itself — including its software, code, user interface, design, icons, text, and the "Better Stream" name and logo — is owned by Better Stream or its licensors and is protected by intellectual-property laws. Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable license to use the Service for your own non-commercial use.

No rights are granted to any third-party content accessed through the Service; all such rights remain with their respective owners. Any open-source components are governed by their own licenses.

Better Stream hosts no content, so infringing material cannot be removed from a service we do not operate. If you believe a third-party plugin or source is making infringing material available, you should contact that third party or the relevant hosting provider directly.

If you believe the Better Stream software or our own materials infringe your rights, you may send a notice to dmca@betterstream.app including: (a) identification of the work; (b) identification of the material and its location; (c) your contact details; (d) a statement of good-faith belief that the use is unauthorized; (e) a statement, under penalty of perjury, that your notice is accurate and that you are authorized to act; and (f) your physical or electronic signature.

We may remove or disable access to material in the Service that is the subject of a valid notice and may, in appropriate cases, restrict users who repeatedly infringe. Legal notices should be sent to dmca@betterstream.app.

The Service is provided "as is" and "as available" without warranties of any kind, whether express, implied, or statutory. To the fullest extent permitted by law, Better Stream disclaims all warranties, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement, and any warranties arising from course of dealing or usage of trade.

Without limiting the foregoing, we do not warrant that: (a) the Service will be uninterrupted, secure, or error-free; (b) any third-party plugin, source, or content will be available, lawful, accurate, or safe; (c) defects will be corrected; or (d) the Service or any content is free of viruses or harmful components. You use the Service and any third-party plugins entirely at your own risk.

To the maximum extent permitted by law, Better Stream and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, data, goodwill, or other intangible losses, arising out of or relating to your use of (or inability to use) the Service or any third-party plugin, source, or content, whether based on warranty, contract, tort, statute, or any other legal theory, and whether or not we have been advised of the possibility of such damages.

In no event shall Better Stream's total aggregate liability arising out of or relating to these Terms or the Service exceed one hundred U.S. dollars (US$100.00), or, where the Service was provided free of charge, the amount you paid us for the Service (which may be zero). Some jurisdictions do not allow certain limitations, so some of the above may not apply to you; in that case our liability is limited to the smallest extent permitted by law.

You agree to defend, indemnify, and hold harmless Better Stream and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with: (a) your use or misuse of the Service; (b) the third-party plugins, sources, or content you install or access; (c) your violation of these Terms or any applicable law; or (d) your violation of any rights of a third party, including intellectual-property rights.

References within the Service to third-party services, protocols, or standards (including compatibility with third-party plugin formats) are for interoperability and descriptive purposes only and do not imply any affiliation, sponsorship, or endorsement by or of those third parties. All trademarks are the property of their respective owners.

We may modify, update, suspend, or discontinue the Service (or any feature) at any time, with or without notice. The Service may update automatically through the browser's extension platform. We are not liable to you or any third party for any modification, suspension, or discontinuation of the Service.

These Terms apply while you use the Service. You may stop using and uninstall the Service at any time. We may suspend or terminate your access to the Service (or the Service itself) at any time if you breach these Terms or for any other lawful reason. Sections that by their nature should survive termination — including Intellectual Property, Disclaimers, Limitation of Liability, Indemnification, and Governing Law — survive.

We may revise these Terms from time to time. Material changes will be indicated by updating the "Last updated" date and, where appropriate, by notice within the Service or at betterstream.app. Your continued use of the Service after changes take effect constitutes your acceptance of the revised Terms.

These Terms are governed by the laws of the operator's principal place of business, and any disputes shall be subject to the exclusive jurisdiction of the competent courts of that jurisdiction, unless applicable mandatory law provides otherwise.

• Entire agreement. These Terms and the Privacy Policy are the entire agreement between you and Better Stream regarding the Service.
• Severability. If any provision is held unenforceable, the remaining provisions remain in full force, and the unenforceable provision will be enforced to the maximum extent permitted.
• No waiver. Our failure to enforce any provision is not a waiver of it.
• Assignment. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets.
• No third-party beneficiaries. These Terms create no rights in any third party except as expressly stated.
